Damage, Property & Negligence (DPN) Policy

At Sherwood Lawn Care, we take pride in delivering high-quality landscaping and lawn maintenance services throughout the Dayton, Ohio area. We are committed to professionalism, safety, and protecting our clients’ property.

This Damage, Property & Negligence (DPN) Policy outlines how we handle property damage, responsibilities, and job site conditions.

1. Property Protection Commitment

Sherwood Lawn Care takes reasonable and professional precautions to protect client property during service. Our team is trained to operate equipment safely and responsibly.

We carry appropriate liability insurance for lawn and landscape operations.

2. Pre-Existing Conditions

Sherwood Lawn Care is not responsible for:

• Pre-existing property damage
• Unmarked sprinkler heads, invisible dog fences, shallow wiring, or hidden utilities
• Loose pavers, unstable edging, or deteriorated structures
• Existing cracks in driveways, sidewalks, or curbing
• Underground drainage lines not clearly marked

Clients are responsible for clearly marking:

• Irrigation heads
• Low-voltage lighting wires
• Invisible pet fencing
• Private utilities
• Any hidden or buried obstacles

Failure to properly mark these items may result in client responsibility for damages.

3. Mowing & Maintenance Risks

Routine mowing and trimming can result in debris being thrown from equipment. While we take precautions:

• Sherwood Lawn Care is not responsible for damage caused by objects left in lawn areas (toys, hoses, tools, decor, etc.).
• Clients are responsible for removing personal property from lawn and landscape beds prior to service.
• We are not responsible for cracked or weakened windows exposed to mowing areas.

4. Weather & Ground Conditions

We are not responsible for:

• Turf rutting or minor surface disturbance during wet soil conditions
• Grass discoloration due to drought, heat stress, or irrigation failure
• Plant decline due to extreme weather conditions

If conditions are unsafe or excessively wet, we may delay service to protect your property.

5. Hardscape & Landscape Installations

For installation projects (mulch, gravel, plantings, patios, berms, drainage systems):

• Natural settling of soil, mulch, or gravel is normal and not considered damage.
• Plant warranties apply only if proper watering and care instructions are followed.
• Sherwood Lawn Care is not responsible for plant loss due to neglect, improper watering, animal damage, or extreme weather.

Written warranties (if provided) will be outlined in your proposal.

6. Reporting Damage

If you believe damage has occurred:

• Notify Sherwood Lawn Care within 48 hours of service.
• Provide photos and a clear description of the issue.
• Do not repair the damage prior to inspection.

We will investigate promptly and, if found to be caused by our negligence, we will coordinate repair or replacement.

7. Limitation of Liability

Sherwood Lawn Care’s liability is limited to the cost of repair or replacement of the damaged property directly caused by our negligence.

We are not responsible for:

• Indirect, incidental, or consequential damages
• Loss of business, income, or personal inconvenience

8. Client Agreement

By scheduling services with Sherwood Lawn Care, the client agrees to the terms outlined in this DPN Policy.
